AptiTest User Terms

These terms are written to cover AptiTest's current launch setup for individuals, business workspaces, scheduled assessments, AI-assisted review, billing, and proctoring-enabled sessions. If a business customer has a separate signed agreement with AptiTest, that agreement controls to the extent of any conflict.

1. Scope and Acceptance

These Terms and Conditions govern access to AptiTest websites, applications, APIs, business workspaces, scheduled assessments, proctoring tools, AI-assisted features, and related services.

By creating an account, accepting an invitation, starting a scheduled assessment, or otherwise using AptiTest, you agree to these terms. If you use AptiTest for an employer, school, academy, testing organization, or other entity, you represent that you have authority to bind that entity.

2. Account Types and Workspace Control

AptiTest supports individual accounts, business-managed workspaces, and candidate access to scheduled assessments. If you use a business-managed workspace, the applicable organization controls that workspace and may configure branding, security settings, team roles, assessments, schedules, and access permissions.

For business-managed assessments, the sponsoring organization may access assessment records, results, submissions, invitations, support logs, and any proctoring artifacts or integrity events associated with its workspace, subject to applicable law and its own policies.

3. Eligibility and Account Security

You must provide accurate information, keep credentials confidential, and use only accounts assigned to you. Individual users must be legally able to enter these terms or use AptiTest with authorization from a parent, guardian, school, or sponsoring organization.

You are responsible for activity under your credentials unless you promptly report unauthorized access. AptiTest may require email verification, multi-factor authentication, or other security steps before allowing access.

4. Business Customer Responsibilities

Business customers are responsible for the assessments they create or deliver, the candidates they invite, the instructions they issue, and the decisions they make using AptiTest outputs. Business customers must ensure they have a lawful basis, required notices, and any required consent for assessment delivery, monitoring, recording, communications, and result review.

If AptiTest is used in employment, education, certification, admissions, or similar high-impact contexts, the business customer remains solely responsible for legal compliance, validation, accommodations, adverse-action processes, human review, and any required disclosures under applicable law.

5. Assessments, Results, and Integrity

AptiTest may host practice tests, custom assessments, scheduled assessments, speaking or writing submissions, and downloadable reports. You may not cheat, impersonate another person, share secure assessment content without authorization, bypass timing or browser controls, manipulate results, or interfere with monitoring features.

AptiTest may delay, flag, invalidate, withhold, or remove results where we reasonably suspect fraud, policy evasion, unauthorized collaboration, security abuse, or integrity violations. AptiTest does not guarantee any score, ranking, pass result, interview, admission, certification, or employment outcome.

6. AI-Assisted Features and Automated Outputs

AptiTest may use AI and machine learning tools to generate practice content, review free-response submissions, transcribe audio, synthesize audio, summarize performance, and surface integrity signals. These outputs may be incomplete, inaccurate, biased, or unsuitable for a particular purpose.

You and business customers must not rely on AptiTest AI outputs as the sole basis for employment, admissions, grading, discipline, certification, or similar high-impact decisions. Human review and independent judgment remain required. AptiTest may change, limit, suspend, or remove AI features at any time.

7. Proctoring, Recording, and Monitoring

Where enabled, AptiTest may process webcam video, microphone audio, browser and device telemetry, session events, candidate identifiers, uploaded evidence, and related integrity signals to support secure assessment delivery and review. Automated checks may include face-presence or multi-person detection, tab-switch detection, session heartbeat, or similar integrity signals.

Business customers are responsible for obtaining any notices and consent required to use proctoring, recording, identity checks, or integrity monitoring. Refusing required proctoring steps may prevent access to a proctored assessment. Automated flags are decision-support information only and should be reviewed with context before action is taken.

8. Customer Content and Permissions

You retain ownership of content you upload or submit to AptiTest, including assessment prompts, passages, logos, images, audio, speaking responses, writing responses, and operational instructions. You represent that you own that content or have all rights needed to upload it and allow AptiTest to process it.

You grant AptiTest a worldwide, non-exclusive license to host, copy, store, transmit, analyze, display, reproduce, and process that content as needed to operate, secure, support, improve, and provide the service, including through subprocessors and AI providers acting on our behalf.

9. Fees, Trials, Billing, and Cancellation

Paid AptiTest plans are billed on a recurring basis unless a separate written order form states otherwise. Free trials or promotional access may convert to paid service unless canceled before the trial or promotional period ends.

You authorize AptiTest and its payment processors to charge applicable fees, taxes, and any add-on services you purchase. Except where required by law or expressly stated in writing, fees are non-refundable, partial billing periods are not prorated, and cancellation stops future renewal charges only after the current paid term ends. Failed or reversed charges may result in suspension or downgrade.

10. Acceptable Use Restrictions

You may not reverse engineer the service, scrape protected data, benchmark it for a competing offering without permission, introduce malware, overload infrastructure, probe for vulnerabilities, bypass access controls, create fake accounts, or use AptiTest to violate law or another person's rights.

You may not use AptiTest content or outputs to develop a competing assessment, proctoring, or AI-review product, except to the extent non-waivable law prohibits that restriction.

11. Third-Party Services

AptiTest may rely on third-party services for payments, authentication, CAPTCHA, communications, storage, analytics, AI processing, or proctoring infrastructure. Your use of those integrated services may also be subject to third-party terms and privacy practices.

AptiTest is not responsible for outages, interruptions, inaccurate outputs, or data-processing issues caused by third-party providers, except to the extent required by non-waivable law.

12. Privacy, Security, and Retention

Our collection and use of personal information is described in the AptiTest Privacy Disclosure and any applicable business agreement. Business customers instruct AptiTest on workspace-level use of candidate and team data, and remain responsible for their own notices, retention settings, and deletion obligations where they act as the controlling organization.

AptiTest uses reasonable administrative, technical, and organizational safeguards, but no service is completely secure. We may retain records, logs, submissions, recordings, and related artifacts for operational, security, legal, audit, dispute-resolution, and product-support purposes for as long as reasonably necessary.

13. Suspension and Termination

AptiTest may suspend, restrict, or terminate access immediately if we reasonably believe there is fraud, abuse, non-payment, security risk, unlawful conduct, infringement, repeated policy violations, or misuse of assessments, AI features, or proctoring controls.

You may stop using AptiTest at any time. Sections that by their nature should survive termination, including payment obligations, intellectual property terms, disclaimers, liability limits, indemnities, and dispute terms, will survive.

14. Intellectual Property

AptiTest and its licensors own the service, software, interfaces, workflows, branding, compiled datasets, and all related intellectual property rights, excluding customer content. No ownership rights are transferred to you by these terms.

Subject to these terms, AptiTest grants you a limited, revocable, non-exclusive, non-transferable right to use the service for your internal personal or business purposes.

15. Disclaimers

To the maximum extent permitted by law, AptiTest is provided on an as-is and as-available basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or uninterrupted service.

AptiTest does not warrant that assessments, AI outputs, transcripts, integrity scores, reports, or recommendations are error-free, lawful for a specific use case, or sufficient to support a final hiring, education, certification, disciplinary, or compliance decision.

16. Limitation of Liability

To the maximum extent permitted by law, AptiTest and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, loss of goodwill, loss of data, or procurement of substitute services, arising out of or related to the service.

To the maximum extent permitted by law, AptiTest's aggregate liability for all claims arising out of or related to the service will not exceed the greater of the amounts paid to AptiTest for the service giving rise to the claim during the 12 months before the event giving rise to the claim, or USD $100 if no paid fees were due for that service during that period.

17. Indemnity

You will defend, indemnify, and hold harmless AptiTest and its affiliates, officers, employees, contractors, and licensors from claims, losses, damages, liabilities, and expenses, including reasonable legal fees, arising from your content, your use of the service, your violation of these terms, or your violation of law or another person's rights.

If you are a business customer, this indemnity also covers claims arising from your assessments, candidate communications, hiring or academic decisions, required notices or consent, accommodations, validation obligations, and any use of AptiTest outputs in regulated or high-impact decisions.

18. Disputes

Before filing a claim, you and AptiTest agree to try to resolve the dispute informally by sending written notice to the contact address below and allowing 30 days to attempt resolution. To the fullest extent permitted by law, any claim must be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding.

If you have a separate negotiated agreement with AptiTest, the dispute terms in that agreement control to the extent of any conflict.

19. Changes to These Terms and Contact

AptiTest may update these terms to reflect product, legal, security, or operational changes. Material updates may be posted in-product or on this page, and continued use after the effective date of an updated version requires acceptance of the updated terms where applicable.
